Features of Intra-corporate Transfer (ICT)
❓What is an intra-corporate transfer?
Intra-corporate transfer (hereinafter - ‘ICT’) is a temporary transfer of employees holding the position of an executive, manager or specialist in a foreign legal entity to branches, subsidiaries or representative offices of this organisation in the Republic of Kazakhstan.
❔What are the advantages of the ICT?
Among the advantages of processing work permits under the ICT are the following:
◽️ the norms of the Law on annual quota of foreign labour force do not apply;
◽️ permit validity period is up to 3 years (with the right to extend it for one year - once) for executives, managers and specialists;
◽️ issuance and renewal of permits under the ICT is free of charge;
◽️ a favourable percentage ratio of foreign and Kazakhstani employees (the share of foreign employees in the category of managers and specialists should not exceed 50% of the number of Kazakhstani employees in the corresponding category) is applied for permits under the ICT;
◽️ does not require the conclusion of a labour contract with a foreign employee in the territory of the RK;
It is important to note that a permit under the ICT is issued on condition that the executive, manager and specialist have at least 1 year of work experience in a foreign legal entity.
❗️Special conditions of the issuance of work permits
The distinguishing feature, in the issuance and renewal of a permit under the ICT, is that the employer is subject to one of the following special conditions at his or her option:
1. Professional training of the citizens of the Republic of Kazakhstan in the speciality of the attracted foreign worker;
2. Retraining of RK citizens in the speciality of the foreign worker;
3. Professional development of citizens of the RK;
4. Creation of additional workplaces for citizens of the RK in specialities in which foreign workers are attracted.
